1. About Kiteza

Kiteza is an online platform that enables creators to connect with their fans, publish content, offer subscriptions, sell pay-per-view (PPV) media, and receive support via a digital wallet. The services are operated by Kiteza, located at Delhi, India.

2. Definitions

• Platform: The Kiteza website, mobile application, and related services.
• Creator: An account registered to publish content, offer subscriptions, and interact with fans.
• Fan / User / Subscriber: An account registered to consume content, subscribe to creators, and buy PPV unlocks.
• Content: All text, images, videos, audio, and messages posted on the Platform.
• Paid Content / PPV: Premium content locked behind a subscription or one-time payment.
• Wallet: A digital store of value inside Kiteza used to purchase content and make payouts.

3. Eligibility

You must be at least 18 years of age to register an account or use the Services on Kiteza. Minors are not permitted to register, create profiles, subscribe, or upload media. If we find that a user under 18 has created an account, it will be immediately terminated.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials (email, password) and are fully responsible for all activities that occur under your account. You agree to notify us immediately at support@kiteza.com of any unauthorized access.

5. Creator Responsibilities

Creators are independent contractors and are solely responsible for the content they publish, the subscription tiers they set, and their interactions with fans. Creators must verify their identity, report earnings for tax purposes in accordance with Indian tax laws, and must not post prohibited content.

6. Subscriptions, PPV, and Wallet Top-Ups

• Wallet Top-ups: Fans can load money into their digital wallet using the checkout gateway. Wallet balances are non-interest-bearing and can only be used to purchase creator services.
• Pricing: Prices for subscriptions and PPV content are determined by the creator.
• Payments: All transactions are processed securely via our payment gateway (Cashfree). You agree to pay all applicable transaction fees.

7. Platform Moderation and Takedown

We reserve the right to review, moderate, blur, lock, or remove any content that violates our Content Guidelines or is reported by users. We may suspend or permanently terminate accounts of repeat offenders or users engaging in illegal, fraudulent, or harmful acts.

8. Content Ownership and License

Creators retain ownership of the intellectual property in the content they upload. However, by uploading content, you grant Kiteza a non-exclusive, worldwide, royalty-free license to host, cache, store, transmit, and deliver the content to authorized subscribers.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.
